How to get a copy of your divorce order or divorce certificate

A copy of your Ontario Divorce Order or Certificate of Divorce can be required for any number of reasons, and especially in matters relating to a name change, property transfer, or marriage abroad. How can you get a copy of these documents?

In Ontario, a Divorce Order or Certificate of Divorce is issued from the court office where the proceeding was filed. You will need to either go in person to the court office or send a request by mail. You can find detailed instructions on the process form the Ministry of the Attorney General. For your convenience, here is a listing of Ontario Courts. If your divorce happened prior to 1979 you’ll need to get your record from the Archives of Ontario.

If you will be presenting your Divorce Order or Certificate of Divorce in a foreign country, you will need to have it apostilled.

What is document apostille?

Canadian document apostille is a process used to ensure your Canadian documents will be recognized abroad.  When your documents are going to be used in another country that is an apostille signatory country, your documents will need to go through the apostille process. To get an apostille, your documents will need to be submitted to the appropriate Canadian apostille office, where they will apply an apostille certificate.

If the documents are destined for use in a non-apostille country, they must go through the authentication and legalization process.
